Monument Bashing Jacksonville general counsel faces no-confidence vote by City Council
General Counsel Michael Fackler faces a no-confidence vote after City Council member Ron Salem filed a resolution that says Fackler’s legal advice has given preferential treatment to Mayor Donna Deegan while failing to represent the interests of City Council.
Deegan quickly affirmed her confidence in Fackler and said she doesn’t accuse him of bias if she disagrees with his legal reasoning.
Salem filed his resolution (2025-81) a day after Fackler issued a binding legal opinion that invalidated legislation approved by City Council awarding a 29% payment increase to Meridian Waste for picking up curbside garbage. Deegan, who supported a 5% increase for Meridian, asked Fackler to determine if council violated the separation of powers outlined in the City Charter by giving the higher increase to Meridian.
Jacksonville has a high bar for either City Council or the mayor to oust a general counsel. Fackler, who was appointed by Deegan and unanimously confirmed by City Council in December 2023, can only be removed on grounds of misfeasance, malfeasance or criminal conduct.
Salem’s resolution does not allege such violations by Fackler, but if City Council were to approve the resolution, it would send a message that Fackler has lost…
