Seems like incidents like this always pop up during democrat regimes. A rogue alphabet agency goes for the big score on shaky charges, screws it up, and bloodshed abounds. Long before Randy Weaver’s entrapment debacle, an old friend was awakened at zero-dark-thirty with an IRS Sub-gun in his face on charges the judge threw out as bogus. Then the ATF botched it’s unnecessary Branch Davidian raid so badly that the feds had to burn down the evidence.
The ATF’s Brian Malinowski farce was as botched a police state overreach as could be perpetrated by the feds. Only the presence of city and county police enabled as much of the truth to come out as already has. No body cams??? If the suspect were black, half the country would have burned down…
The whole defense of this raid seems to be: ‘Because We Can.’ That is not a sound legal argument.
What we know about the raid:
The original premise that Malinowski was an illegal dealer was highly questionable. He was most likely targeted because of his status as Clinton National Airport Manager. Actual illegal dealers are a dime a dozen in the LR Hood…
The ATF Came loaded for bear to serve a SEARCH warrant against a man with no record. It was not an arrest warrant against a violent felon.
Just like in the Davidian case, Malinowski could have been served anytime. Instead the ATF chose a pre-dawn strike instead of daylight hours or simply serving it as he was leaving for work.
ATF covered the doorbell camera. Yet, they couldn’t bother to ring that same doorbell.
ATF did knock, briefly, then proceeded to bust through a storm/security door and an exterior door.
ATF Violated it’s own procedures. The officer with the ballistic shield labelled “POLICE” did not enter ahead of other agents.
ATF did not announce their entry at any time.
In Arkansas, as most other states, this is not a raid. It is not a search. It is a home invasion by armed intruders, warrant or not. Mr. Malinowski, awakened from his sleep by intruders he had no knowledge of being feds, had every right to defend his home. After firing one shot. Those intruders killed him as his wife stood behind him.
“From the side where Bryan Malinowski saw intruders coming into his home, there were no markings that identified them as police, and they were not making any announcements that they were police,” said Attorney Bud Cummins who represents Bryan Malinowski’s widow.
“Never rang the doorbell. Knocked and waited 20 to 25 seconds before they started forcibly breaking open the door and never made an announcement again that they were police, who they were, and what their purpose was, and that’s really where the constitutional violations occur…”
According to KARK: “The lawsuit also claims Malinowski’s widow was wrongfully detained for hours with no legitimate reason. Neither she nor her husband had an arrest warrant for them, only a search warrant alleging Bryan Malinowski was selling firearms without a $200 license, which requires more record keeping of who guns are sold to.”
There it is in a nutshell. Because ATF doesn’t like what they term the ‘Gun Show Loophole,’ a respected member of the community is dead and his wife is wrongfully detained for hours with brains spattered all over her.
Cummins added, “When there is no fact or circumstances to lead law enforcement to think there is risk of danger, risk of destruction of evidence, risk of fleeing, there is absolutely no reason to use these tactics, and by golly, if you are going to use them, you’ve got to do it right.”
